      Understanding Recent Amendements to the PACT Act

      The Prevent All Cigarette Trafficking Act (PACT) Act law initially went into effect on June 29, 2010. The original PACT Act featured several major components: it regulated the mailing of cigarettes and smokeless tobacco products to consumers through the U.S. Postal Service; added new requirements for registration, reporting, delivery, and record-keeping, including a List of Unregistered or Non-Compliant Delivery Sellers; increased penalties to a felony up to 3 years imprisonment; and gave ATF inspection authority to examine any records required to be maintained and any cigarettes or smokeless tobacco kept on the premises.

      The Preventing Online Sales of E-Cigarettes to Children Act, which placed ENDS under the PACT Act, was enacted on Dec. 27, 2020, and likely becomes effective 90 days after enactment (March 27, 2021). This not only applies to e-liquid, tanks, and mods, but to all vapor products including those used for CBD/Delta-8 as well as 510-thread batteries. Effective 3/27/21 we will no longer be able to ship any of these products through USPS. As you may already know, earlier this month FedEx stopped accepting shipments of vapor products. After the 27th of March, there will be absolutely no way to ship vapor products to consumers

      We understand that this is an inconvenience, but it is unfortunately the way the law has been written. Stay tuned, we will be working to come up with alternatives that are legal under the new amendment.
